Mediation is a collaborative, voluntary process that allows for confidential dispute resolution entirely outside of the court system.
With the help of a neutral third party known as a mediator, the process will focus on respect, courtesy and equity for all parties. Cooperation is key, as mediation does not aim for choosing one side or the other, or crowing “winners” and creating “losers” - rather, its aim is to help parties mutually arrive at a binding solution where everyone can go home happy and satisfied with the results reached.
Like mediation, arbitration makes use of a neutral, qualified third party outside of the court system and focuses on equity and respect in its proceedings. However, unlike mediation, arbitration renders a final, binding decision for the parties, without necessary regard for individual context, input or agreeability from those involved.
Arbitration provides more of a certainty of a final outcome as compared to mediation, and provides a more affordable and speedy option to dispute resolution as compared to court proceedings.
